Partner

Kukuh K. Hadiwidjojo commenced practising law in Indonesia in 1997 after graduating from the University of Indonesia, and further attended the same university for the Notary Master Degree. With his extensive knowledge, innovative insights and approach in the legal practice, he has handled and successfully represented clients in the banking and finance, merger and acquisition, debt restructuring, and the capital-market field.

In the financial and banking sector, Kukuh has wide-raging experiences. In the 1998 Asian financial crisis, he was involved in bank resolutions, takeover and recapitalization, also engaged in asset recovery measures and deposit guarantee program scheme. He was handling the bankruptcy case of PT Bank Global International Tbk (in liquidation process), the most well-known bankruptcy case in 2005. The case was about a bank in the liquidation process, which was sued for bankruptcy by some of the customers. Kukuh won the case, and according to him, if Bank Global was declared bankrupt by the court, the state could potentially suffer a loss of Rp732.9 billion. During the global financial crisis in 2008, Kukuh was also involved in the restructuring of PT Bank Century.

In the capital market sector, Kukuh is registered as Capital Market Legal Consultant (HKHPM), and presently he is a secretary of Standard Committee of HKHPM. He has comprehensive experiences in supporting many companies in the capital market area, among others, are PT Nippon Indosari Corpindo Tbk (ROTI), PT Suryamas Duta Makmur Tbk (SMDM) and PT Bank Tabungan Pensiun Nasional Tbk (BTPN).

Not only the financial and banking or capital market sector, Kukuh has extensive experience in commercial arbitration and criminal litigation. He succeeded in proving that the defendants were innocent and acquitted of criminal charges in the case of the East Kalimantan Fertilizer Pension Fund (DAPEN PKT).

According to Kukuh, "law enforcement in the financial services sector has proven to be not easy, the effect on the financial services sector is also likely to affect the stability and national economic system, furthermore, the distortion will also affect the legal certainty in the financial services sector, and the industry is in dire need of legal certainty to create a stable and sustainable economic system."

As a legal practitioner, Kukuh is also frequently a speaker in training, seminars or engage in a talk show about the law. Among them are training on capital market law, legal contract drafting, limited liability company, business law, family law and inheritance law.

Hidayat Ardibrata is currently the Managing Partner of the firm. Just after finishing his law school at the University of Indonesia, Hidayat had been working as an associate lawyer at Benedicta & Associates since 1997 until 1999. He then moved to Roedl & Partner, an international tax and legal consulting firm, and assigned as legal advisor since 1999. He expanded his experience in the legal field as associate lawyer at Assegaf Hamzah & Partners and seconded as the Corporate Secretary and General Legal Counsel at PT Holcim Indonesia Tbk, one of the largest cement companies in Indonesia, during the company's turnaround period in 2002 until 2005. During his lawyering career, he has been involved in a variety of capital market transactions, M&A, debt restructering, project financing, banking and insurance legal matters. He is experienced in cases brought before the Commission for the Supervision of Business Competition (KPPU) and Singapore International Arbitration Centre (SIAC). He has also experience in drafting and all phases in negotiating EPC contracts in the mining industry and the energy sector. Dhani joined HWMA in December 2014, soon after he obtained his bachelor degree from University of Padjajaran, majoring in private law.

During his years of experience, he handled various legal matters including foreign direct investment, banking and finance, capital market, industrial relations, commercial litigation and alternative dispute resolutions.

Dhani has been focusing his practice on commercial litigation and dispute resolutions. He has represented local companies, multinational companies, and state owned enterprises in court litigation in various kind of cases, such as intellectual property right cases, industrial relation relations cases, suspension of debt payment obligation proceedings, administrative law dispute with government departments, land and property dispute, and other various kind of commercial disputes. He is also experienced in representing clients in arbitration proceedings at Badan Arbitrase Nasional Indonesia (BANI). One of his notable works is representing a prominent informal course franchisor in various commercial dispute and criminal allegation related to the trademark acquisition with the total claim over IDR 1 Trillion.

Punia joined HWMA as an associate in March 2017. She graduated cum laude from University of Diponegoro, in 2016, majoring International Law. Prior to joining HWMA, she has been working in private company.

She has experience representing corporate clients in a variety of transactions including merger and acquisitions, asset and equity acquisitions, equity financing, corporate structuring activities, capital market and good corporate governance. She also advises on a diverse range of financial and banking transactions, with particular focuses on facilities for infrastructure financing.

Punia has actively involved in the capital market transactions. She has handled diverse capital market transaction such as Initial Public Offering, Right issue, and Bond Issuance. During her first year in HWMA, she has participated in a pioneer project of IPO transaction for business support medium and small enterprises. She has also assisted various banks in the issuance of Medium Term Notes and Bonds, such as the bond issuance of PT Bank BTPN, Tbk with the value of IDR 1 Trillion in 2019.

Punia has maintained a good government relation in a variety of state departments and institutions. She regularly advises on legal administration practices and corporate secretary services for HWMA's corporate clients. Astrid graduated from University of Lampung in April 2017. Before joining HWMA in August 2017, Astrid once completed an internship at Public Trustee Office Jakarta Ministry of Law and Human Rights of the Republic of Indonesia.
